How can I get my fathers possessions back from a non family?
When my father died, he was living two hours away from the rest of his family, and seven hours from me. A friend close to him took the liberty of cleaning out his apartment, but five years later he is still telling me (since he moved close) that he will get them out of storage for me when he goes upstate. He has also taken some things for himself – such as carnival glass vases I received when I was born, many cobalt blue glass items, movies, some of his clothes…this friend is not a good person, but a drug addict and a liar. What can I do? I don’t have anything of his.
You failed to mentioned whether or not your dad died intestate or with a will. This is highly important because if he died and made this “friend” his executor of his estate in a will, there is very little the police can do for you if he is upholding the terms of the will.
Getting these items back is more complicated than just calling the police. If he died and no one took your father’s estate through the probate process, it is possible ALL of his belongs have been stolen and illegally obtained. You will need to go through the probate process first and then get an Order from the Court to seize all the “stolen” property. If he died with a will, it will need to be proven that this “friend” is in violation of the terms.
Visit with a probate attorney in the state that your father died. He/she will be able to determine who has rightful ownership of your deceased father’s belongings. This is not a police matter. This is a probate matter to determine rightful ownership. Once you do that, THEN you can get the police involved with the proper Orders.
